Bill C-279 When Trans Rights are Special Rights

A trans reader recently brought this travesty of a Canadian bill to my attention. Bill C-279 would grant unique rights to those who develop the preventable social disease, Gender Identity Disorder by adding "gender identity" and/or "gender expression" to Canadian Human Rights. There are a variety of issues with this codswallop, but several stand out more than all others.

First, a brief on gender identity and gender expression. Gender identity was a term coined by the pro-pedophile Dr. John Money. GI is defined as your interior sex, regardless of the sex you are made. The medical community and the Trans Politic have kept/embraced John Money's anti-feminist homophobic gender identity term and conveniently buried his documented pro-pedophilia leanings under the nearest carpet. Gender Expression, equally misogynistic and homophobic is how you express you inner sex via your body. Together they form the Gender Straight Jacket which continues to dictate the male and female experience. And in the case of females, limits our life experience to such an extent we still have not yet realized what it is to be human.

Now back to bill C-279, GI and GE and why neither belong in a Human Rights Bill. Gender Identity, being simply the interior of a person by its very intangible nature cannot be protected, by a Human Rights Act or any other law for that matter. And Gender Expression, meaning how one wears/performs male or female either per the Gender Straight Jacket or completely naked needs no more protections than say punk rockers from the 70's did. Expressing oneself differently, may not always be popular and occasionally be quite difficult, but rarely is it life threatening to such a number of people that laws beyond state/federal laws would be need to be enacted.

And I say this as someone whose sex has been and remains either questioned or mistaken as the sex it is not. Are things like public restrooms an issue for me? Of course. But that isnt because as a woman who carries her female/feminine body differently needs legal protections when entering the "ladies loo". It isnt even because how I carry my body gets me mistaken for male when entering the "ladies". It is because women live and breathe in a pure rapists culture. So that how I am perceived (male) when seen in the "ladies" immediately broadcasts a silent alarm, whereby a potential rapist is seen first instead of a woman different, which always comes second.

Which leads me to the first serious issue I have with GI/GE being added to a Human Rights Bill. Because we women live in a rapist culture NO male or female identifying as male, belongs in private women's spaces, no matter how they "express" themselves period! The addition of GI/GE not only opens the door for male transitioners (which we've established are primarily men who sexually fetishize the patriarchal idea of woman) but any male who claims he is a female inside. In other words, male predictors would have a free pass into women's/girls locker rooms, bathrooms, showers, changing rooms etc. AND be legally protected in doing so!

The second important issue the addition of GI/GE to Human Rights raises is the serious harm it creates for gays and lesbians. Far Right leaders/groups have long purposefully blurred the rights gays/lesbians continue struggling for with our wanting "special rights". Given there is zero need for GI/GE to be added to a Human Rights Bill AND given it is the Trans Politic fighting to get GI/GE added, the Right can easily prove their original argument. Proven because Trans is now irrevocably linked to the Gay and Lesbian Community. So while it may not be the Gay/Lesbian community campaigning C-279, whether this is passed into the Human Rights Bill or not, every human right that gays and lesbians fight for would and will be suspect going forward.

No, Dirt - you have established that, not anyone else, and you are entirely wrong, outdated, and bigoted.

I don't know what you do when you enter a toilet, Dirt, but I go there to piss, and so do all those trans women you're so determined to dehumanise. The perversions you speak of are all in your head.

Maybe if you spent your time doing useful things to help all women, and less attacking the rights of trans people to exist, you wouldn't be such a vile person.

  3. I was wondering when dirt was going to make a posting about this.

I am in total agreement with the notion that protecting "gender identity" is completely nonsensical. How on Earth can you institute protections for a FEELING? I'm outraged that "trans" people are banding together and fighting for things like this. To what end?

There are a few obvious cases posted here regularly, like the gym teacher. It's entirely obvious to me (and it should be to everyone else) that having him/her in a high school girls locker room borders on child abuse. Prancing around telling people you are a woman when you are clearly NOT should have a one-way ticket arranged to whatever passes for a mental institution these days, because something is clearly wrong with that individual.

It's interesting to note that the psychiatric professional consulted on the bill was against providing any special protections to transgender people: "scientifically, there is no such thing as transgender". He's RIGHT! That's what drives me crazy about the trans flag wavers running around condemning him for saying such a thing, and linking like crazy to that bizarre 2011 study that tried to show there was a difference in trans brains. There is no test, no way to confirm, other than a subjective diagnosis and the word of the transgender person.

    That's NOT ENOUGH, I'm sorry.

  4. Gays and lesbians should not be given special rights and protections either. Sexual preference is a choice, and an intangible one at that. There is nothing to prove that homosexuality is inborn or anything but a perversion. Having lesbian gym teachers in the girls' locker room borders on child abuse. Normal woman should not have to share the ladies room with lesbians who leer at them... lesbians are no better than straight men in this respect. We need to eliminate all special protections for perverts such as homosexuals and queers, and do it ASAP.

I'M A FEMALE, AND MALES HAVE BEEN PERVING IN WOMEN'S RESTROOMS FOR AGES. (peep holes, hidden cameras etc.) Registered sex offenders like Paula Witherspoon have used women's restrooms. Just google his name. Also, men have dressed up as women to get into women's restrooms. It's all about perving on women. It isn't new at all.

As to lesbians, because they are women, lesbians are far MORE LIKELY to be victims of sexual abuse, incest, or rape than perpetrators. All we have to do is to look who is and isn't in prison. The crime statistics speak for themselves. The numbers don't lie.

"National criminal justice statistics reveal that of all adults and juveniles who come to the attention of the authorities for sex crimes, females account for less than 10% of these cases (FBI, 2006). Specifically, arrests of women represent only 1% of all adult arrests for forcible rape and 6% of all adult arrests for other sex offenses."

"In contrast to the approximately 140,000 men incarcerated in prisons nationwide for sex crimes, only 1,500 women are estimated to be imprisoned for these offenses (Harrison & Beck, 2005). They represent only 1% of all adults incarcerated for sex offenses, and 2% of all females in prison. "

U.S. Department of Justice, Center of Sex Offender Management

Rape and sexual assault is a serious feminist issue that I don't take lightly. Lesbians are female.

Is this coming from the Iranian government or the trans thought police?

Gay and lesbian hatred is nothing new. Indeed, in Iran, gay men are hated so much that many have been coerced into sex reassignment surgery. They get their balls cut off. Iran will execute homosexuals, but the government helps pay for sex reassignment. What does this tell you? This is how Iran deals with their homosexual problem.

  7. In all honesty, I am not Canadian, and I'm not familiar with this particular piece of legislation. However, I do know that "gender identity" laws in Washington State have created something of a huge uproar surrounding what happened at Olympia, Washington with Colleen Francis. All a person has to do is google "Colleen Francis" The Colleen Francis incident even managed to make headlines in UK news sites such as:

    http://www.dailymail.co.uk/news/article-2227562/Colleen-Francis-Outrage-transgendered-woman-permitted-use-college-womens-locker-room-exposing-himself.html

As to Colleen Francis, according to the police report, it was a mother of a 17 year old girl who complained that her daughter saw what clearly was male genitalia in the women's locker room and sauna. Franics is a 45 year old, ex-military male. Why wasn't a 45 year old male arrested for walking around naked in front of 17 year old girls? By the way, Francis still had his penis when he did this. The answer is simple. "Gender identity" laws trumped sex and the interests of women in Washington State.

Before people start commenting about this proposal, we need to know how it will impact women. Because transwomen (biological males who "transition") are not female or women, I will try to focus my comments on the unique interests and concerns of women. After all, women are a historically oppressed class of people, and it would take this entire blog and at least a hundred other blogs to properly describe the ways in which women have been discriminated against, raped, sold into prostitution or slavery, and brutally victimized. The various crimes against the female sex are too numerous to list in this blog. I recognize that transgender identified individuals also experience discrimination and violence, but the protections of transgender people must not come at the expense of females.

  8. This letter was a harbinger of sorts of what was to come. This preceeded Colleen Francis.

    http://sexnotgender.com/gender-identity-legislation-and-the-erosion-of-sex-based-legal-protections-for-females/

"In response to the United Nations Entity for Gender Equality and the Empowerment of Women’s call for communications dated June 14, 2011 regarding allegations of human rights violations affecting the status of women, we write to advise you of a legal development in the United States that compromises hard won sex-based classification protections for females.[i] This legal development – in which gay, lesbian, bisexual and transgender (“GLBT”) organizations[ii] and individual activists work to enact protections based on “gender identity” – thus far has occurred in Minnesota,[iii] Rhode Island,[iv] New Mexico,[v] California,[vi] District of Columbia,[vii] Illinois, [viii] Maine,[ix] Hawaii,[x] New Jersey,[xi] Washington,[xii] Iowa,[xiii] Oregon,[xiv] Vermont,[xv] Colorado,[xvi] Connecticut[xvii] and Nevada.[xviii] We anticipate that GLBT activists will push to enact similar legislation in additional states in upcoming years, including in Maryland and Massachusetts, the states in which the authors of this communication reside. In addition to compromising rational sex-based protections for females, this legislation incorporates stereotypical ideas of “what is female” into law...

More importantly, as females, we are concerned that in the attempt to provide protections for a few, we will compromise the protections of the many.

Specifically, the proliferation of legislation designed to protect “gender identity” and “gender expression” undermines legal protections for females vis-à-vis sex segregated spaces, such as female-only clubs, public restrooms, public showers, and other spaces designated as “female only.” Females require sex-segregated facilities for a number of reasons, chief among them the documented frequency of male sexual violence against females and the uniquely female consequence of unwanted impregnation resulting from this relatively common form of violence.[xix] Public policy, therefore, rationally permits sex segregation in certain settings where a reasonable expectation of privacy exists."

  9. Apparently, some GLB in Canada don't want to be associated with the "T" as in transgender. What does this have to do with the issue at hand? When a bazaar, creepy, and sad example of "gender identity" laws run completely amok, (aka Francis), clashes with the interests of females and their right to privacy as it did in Washington state, the conservatives, smelling blood, will use it to blame the GLBT.

"LOL, LOL, LOL, LOL, Well, good for them. Just another example of trying to force sick moral ideals on the rest of us. Just like those gay 'marriages', this is something that just isn't going to accepted simply because those who want to cram that sickness down our throats, want to be appeased. Let's put a stop to this crap immediately!"

    http://www.kirotv.com/news/news/transgender-woman-told-leave-womens-locker-room/nSWT4/

I want to scream at these people, "He is not gay". Francis was married a couple of times, but to women not men. What the heck does Colleen Francis's penis have to do with same sex marriage?

After Colleen Francis and his stunt went viral online (even some UK news sites), some conservatives tried to blame it on the GLBT as in gay, lesbian, bisexual, and transgender. I really read this on some blogs. Gay was lumped in with transgender, although Colleen Francis is a heterosexual male who was married a couple of times, and always has found women "intoxicating". I'm as liberal as they come, and I am an anti-war environmentalist, Bush-hating leftie, I was even a member of the ACLU once (I actually had the card to prove it), so I can trot out my left leaning credentials. I despise the conservatives, but their raising hell over Colleen Franics makes sense, and the GLB doesn't want to claim him. It really disturbed me that the conservatives who I hate start lumping trans in with gay and lesbian. At any rate, someone took a scree shot before Francis took down his OK Cupid profile. He says he is "gay", but then says that if you are a man, do not contact him. He finds women intoxicating, and he adores them. To really understand Colleen Francis, you must read his long and detailed OK Cupid profile

  10. What have some GLB in Canada said about this issue:

    "Trans bullying/Deliberately vague laws
The homophobia and hostility of trans activists is just as prevalent in Canada as it is in the US. You have only to look at the bizarre attacks by trans activists on Xtra. Go look at the video on Youtube in which Xtra attempted to conduct a panel discussion to assist it in covering the "trans community." Xtra didn't have to do this. It was a courtesy. The panelists, all bizarre trans activists, extended no thanks nor even basic respect to Xtra. Instead, they promptly attacked Xtra for conducting the panel discussion in which they were participating, openly disrespected its staff, and demanded editorial control over the paper. This is typical of the hegemonic, bullying mindset of trans activists. Sexual orientation is, in the many dozens of gay rights laws in the US, defined as homosexuality, bisexuality, or heterosexuality. It really isn't that complicated. Trans activists want to leave gender identity undefined because they can't agree themselves what it means. That and it serves their purpose to terrorize businesses and individuals by leaving the boundaries of the law uncertain. It is unacceptable to pass a law prohibiting certain conduct and imposing penalties on Canadian citizens, and to leave unclear and undefined what the proscribed conduct is. It is absolutely unacceptable to say that the courts will work it out. Canadians have a right to know what the law is *before* they are hauled into court. When trans activists have tried to pull this nonsense of proposing a law without definitions in the US, as they did in Anchorage Alaska this year, the proposed law was quickly shot down. As it should be now in Canada."

At any rate, if another Collen Francis case comes along, I hope they don't blame it on gay men and lesbians. If gender identity laws aren't adequate to protect girls and women, then this issue isn't going away. Cathy Brennan is more tenacious than people think, and she does have a point. The conservatives both in the U.S. and Canada will use another Colleen Francis asinine prank as a stick to bash GLBT even though many G and L are already sick and tired of the T.

  12. Comments submitted by Toronto psychiatrist Dr. Berger:

    http://genderidentitywatch.files.wordpress.com/2013/01/testimony-of-dr-1-berger-re-c279.pdf

"Dr. Joseph Berger Testimony on C‐279 (Canada)

    January 19, 2013

Toronto psychiatrist Dr. Joseph Berger testified on C-279 that there is no such thing as a “transgendered” person, and that terms such as “gender expression” and “gender identity” used in the bill are at the very least ambiguous, and are more an emotional appeal than a statement of scientific fact.

“The medical treatment of delusions, psychosis or emotional happiness is not surgery,” Dr. Berger stated.

“On the other hand,” Dr. Berger continued, “if these people are asked to clarify exactly what they believe, that is to say do they truly believe whichever of those above propositions applies to them and they say ‘no’, then they know that such a proposition is not true, but that they ‘feel’ it, then what we are talking about scientifically, is just unhappiness, and that unhappiness is being accompanied by a wish – that leads some people into taking hormones that predominate in the other sex, and even having cosmetic surgery designed to make them ‘appear’ as if they are a person of the opposite sex.”

  16. Codifying the notion of stereotypes based on sex into law......is this what we are doing...

"As an additional matter, definitions of "gender identity" that suggest or codify into law that there are ways of expressing one's self (or behaviors or appearances) "consistent or congruent with biological sex" presents a risk to females, as such definitions codify the notion of stereotypes based on sex into law. Traits stereotypically assigned to females such as care-taking, emotionalism, and weakness have served as sufficient legal justification for women's exclusion from employment, participation in government, and many other critical social functions. Archaic stereotypes are directly responsible for the denial of female credibility and intellectual authority, in addition to causing the historical marginalization of females, lower social status vis-a-vis males, and lack of power to engage equally with males, Even where law has evolved to formally prohibit sex stereotyping; women continue to suffer from the lingering effects of sexist ideologies about female inferiority. ...We believe that "gender identity" laws that codify the notion that there are traits, manners of expression, or modes of appearance that are consistent or inconsistent with one's biological sex violates United Nation's conventions seeking to eradicate sex stereotyping. "

    http://www.scribd.com/doc/72976111/UN-BrennanHungerford-08012011-

What does "gender identity" mean? A man might say, "I feel like a girl or woman". If we ask what does "feeling like a woman" mean, the person might say, "I've never liked sports, and I'm not mechanical." Or, "I'm passive and emotional". He might say, " I prefer colorful shirts over dark, tailored suits, and my hair needs to be a certain way." Is this individual a woman, or what society says is a woman? The labels that we assign to certain behaviors are just that. They are labels and nothing more.

In many cases, "gender identity" just means the traditional, stereotypical views of what society defines as masculinity and femininity. Male or female is a biological fact, whereas acting "feminine" or "masculine" is socially constructed. "Gender identity" can be nothing more than sitting into place stereotypes based on sex.

TRANSGENDER AND THEIR ALLIES HATE WOMEN.

I wonder who typed this misogynistic crap? I'll discuss this later.

The subject at hand is C-279 which deals with including transgender in Canadian laws. TRANSGENDER ARE A MINORITY. WOMEN OUTNUMBER THEM. Women have the voting power to change the laws.

Yes, I admit that males have literally wrecked havoc upon the planet, and if climate change doesn't do in the human species, some other MAN MADE monstrosity will. Mother nature will endure. On the extreme long time line of human history, Homo sapiens are nothing but a tiny, insignificant dot. The "bros" are not only doing great violence to the "hos", they are killing off other "bros" in large numbers. Lower class "bros" are nothing but cannon fodder in the pecking order, completely expendable. They surely must realize this. Perhaps deep down in their hearts they know they are disposable, and this is why the only way they can feel good about themselves is by deeply hating women. In other words, projecting their own internal weakness on the "hos".

"No, women cannot win. Women will never win. Proof... the Patriarchy has been around for THOUSANDS of years, despite half of the people being female. Women always have been and always will be the underclass.

I can guarantee this individual that mother nature will eventually prevail. The earth is 4.5 billion years old. That is billion with a "b" not thousands of years old. Bacteria have out lived everything, and they surely will out live us. Some scientists believe that the original source of the mitochondria that all humans inherit solely from their mothers is ancient bacteria.

Now, back to C-279 because this is the subject at hand, and I've rambled on long enough.

    IT SHOULD FAIL! DROP C-279!

  27. You will likely be the last generation of whiny women. Just as drugs are being developed to prenatally prevent female fetuses from becoming lesbians, prenatal treatments will be used to ensure that future females will be content with their lot in life. No more bitching and nagging? What a wonderful world that will be!

    Regarding your comment....

"No, women cannot win. Women will never win. Proof... the Patriarchy has been around for THOUSANDS of years, despite half of the people being female."

The reason why things are changing and getting better for women, is because cheap, reliable birth control actually exists now. In the whole history of humanity, it has only been around for less than 100 years. Condoms and some other unreliable methods have been around a long time, but highly effective methods used by the woman have not. As women gain control over their reproductive capacity, they gain control over their lives. It has been pivotal for the liberation of women.

In a short span of time, women went from the burden of having 8-13 children on average to 2, or less!! This has allowed women to enter college at ever higher rates (current U.S. data shows more women are enrolled in college today than men) and then those women enter the workforce. The biological revolution is already at hand, and the global interconnectivity that the internet has caused, will only accelerate women's liberation.

Women are fucking awesome! We continue to go forward despite all the shit that men and society have thrown our way. We are truly the most resilient sex and we don't have to resort to mass shootings just because something doesn't go our way.

    Hallelujah!!

  32. Sex discrimination as legal strategy

This is absolutely brilliant legal thinking. It has to be read to be appreciated.

"Sex discrimination demands particular kinds of behavior from one sex, but prohibits the same behavior from the other sex.[i] For example, wearing dresses is ok, but only for females; engaging in sexual relations with females is ok, but only for males. Legal prohibition against sex discrimination encompasses the social policing of both homosexuality[ii] and sex-role (or gender) non-conformity.

Instead of isolating gender non-conforming and gender dysphoric people as a disordered class of persons whose defining characteristic is their departure from normative sex role behavior or appearance, we should recognize enforcement of sex role limitations as universal violations of our human rights—even when they are supported by medical professionals.[iii],[iv],[v] Considering gender dysphoria on an individual level, as special kind of medical condition, evades examination of the oppressive psychological effects of mutually exclusive sex roles. This is particularly disturbing when the suggested medical treatment for gender dysphoria causes sterilization, infertility, and other physical complications.

Sex discrimination as legal strategy can be leveraged by anyone, not just female plaintiffs. It attacks a wide range of sex-role discrimination while simultaneously avoiding the pitfalls of both trivializing biological sex and reifying sex roles by privileging self-identified sex (or gender identity) over biological sex...

This is the most effective and sustainable legal strategy with the strongest precedent.[xi] It protects all gender non-conforming people without forcing them to claim a special kind of “gender identity,” that they are suffering from a special medical condition, or that they are members of a special group called “trans.” Sex discrimination as legal strategy can be used to protect females, gays and lesbians, and gender non-conforming people including transsexuals from the tyranny of compulsory heteronormativity– the principle evil we aim to deconstruct."

Ms. Hungerford, I applaud you! Standing ovation!!!
